General Terms and Conditions

1. Scope

1.1. The following General Terms and Conditions (hereinafter "GTC") govern the contractual relationship between Olha Reshetnyk, Rotmurgstraße 46, 72270

Baiersbronn (hereinafter "Effiside," "we," "us," or "our") and our customers

(hereinafter "Customer") for our services in the field of German courses (individual and group lessons) and preparation of employees and specialists for the German job market. By availing of our services, the Customer agrees to these GTC.

1.2. In the context of these terms and conditions, "Customer" includes both consumers and entrepreneurs. "Consumers" are natural persons who enter into a business relationship with us without acting in the exercise of their commercial or self-employed professional activity. "Entrepreneurs" in the sense of these terms and conditions are both natural and legal persons, legal entities, and partnerships with legal capacity that enter into a business relationship with us and do so in the exercise of their commercial or self-employed professional activity.

2. Conclusion of Contract

2.1. The registration forms on our website are non-binding and do not obligate you to purchase our services. Registration via the forms serves solely as a nonbinding inquiry or expression of interest. Only after confirming your registration and signing the corresponding contract are you bound by our services.

2.2. Registration for our services can be done via email or in writing. Upon receiving your registration, we will send you an order confirmation and a lesson contract via email. You are required to sign this lesson contract and return it to us via email or post to confirm your binding booking.

2.3. Appointment commitments made by Effiside, especially in connection with group courses, are subject to the condition of the group being fully booked. In the event of the cancellation of lesson units, we offer replacement lessons.

2.4. We would like to point out that Effiside assumes no liability for not achieving a specific learning and teaching success. Effiside's specifications regarding the required lesson units to achieve a particular teaching goal are based on the Common European Framework of Reference for Languages (CEFR) and our experience. However, it is possible that actual requirements may differ in individual cases. We are happy to provide individual advice to our customers to determine the best possible learning strategy.

3. Right of Withdrawal

3.1. You have the right to withdraw from the contract without giving any reason before the course starts or within fourteen days after the course starts.

info@effiside.com) by means of a clear statement (e.g., by post or email) about your withdrawal. You can use our withdrawal form, although it is not mandatory. We will send you a confirmation of receipt of your withdrawal by email within 5 working days.

3.3. Consequences of withdrawal:

In the event of withdrawal by the Customer, the following regulations apply:

Service component: If you have used the service during the withdrawal period, you are obligated to pay us a reasonable amount. This amount corresponds to the proportion of services provided up to the time of your notification of the exercise of the right of withdrawal in relation to the total scope of services provided for in the contract.

Refund: The refund will be made immediately and no later than fourteen days from the day we receive your notice of withdrawal from this contract. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. In no case will you be charged fees for the reimbursement.

4. Price Information and Payment Terms

4.1. The prices for our services at Effiside correspond to the prices stated at the time of ordering.

4.2. The prices stated on our website www.effiside.com or in Effiside's marketing and sales materials are final prices and include the statutory value-added tax, if applicable to the respective service or product.

4.3. The current prices can be found in the respective service description. After signing the contract, the Customer is obligated to pay the specified price within 14 days and no later than before the start of the course. We reserve the right to claim higher damages for delay.

4.4. Payment methods and conditions:

Payment for all services is made by invoice. The Customer has the option to pay the full amount or in installments. In the case of an installment payment agreement, the first installment is due at the beginning of the course. Subsequent installment payments are made on the dates specified in the contract.

5. Special Product-Specific Conditions

5.1. Group Course or Intensive Group Course

The start dates, times, and days of the week for live lessons are determined during consultation. Effiside reserves the right to change the start dates at any time. In the event of such a change, the Customer will be promptly informed.

With the consent of the course participant and after prior consultation, the Customer may be moved to another group for pedagogical reasons. This transfer is for the purpose of optimizing the group's learning progress or the individual customer and is only done with the explicit consent of the Customer.

The Customer agrees that live online group lessons will be recorded and made available to participants via the group chat.

In cases where the Customer has already participated in a group course, the following conditions apply:

If the Customer is unable to attend the lessons due to circumstances such as illness, vacation, professional hindrance, or similar reasons, the lesson costs remain payable. However, the Customer has the option to receive a recording of the lesson or to book individual lessons at an additional cost to catch up on missed course content.

Refunds for already paid but unused lesson units are excluded. Likewise, there is no entitlement to a refund of the costs for already received teaching materials. Effiside's and the participant's right to terminate the contract for good cause remains unaffected. Any termination must be made in writing to be effective.

5.2. Individual lessons and employment support

The dates, times, and days of the week for individual lessons as well as employment support are determined in consultation between Effiside and the Customer. These can be changed at any time at the request of the Customer or Effiside. Cancellation on the day of the lesson is generally not possible unless the Customer is prevented due to illness. Already paid lesson hours cannot be refunded or paid out. A rescheduling of the lesson is only possible for good reason.

The revocation of the contract is possible at any time but requires a written notice and a notice period of one month to the end of the month.
